Windy City Silkscreening ("Windy City") is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the Windy City Site (collectively the "Contents") are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by Windy City.

Generally, products created using images available on the site should not be resold commercially. In the event that you wish to resell such products, you agree to contact Windy City and verify the legality of reselling such products prior to doing so. Designs created using the text tools and images available through the site are in no way the exclusive property of the customers who assemble such designs. Windy City retains the right to display such designs or offer them (or variations of such designs) to other customers.

WCS endevors to make sure pricing information on the website is accurate. However, from time to time there may be an error. WCS regrets this happening and you will be notified of the error and provided with the accurate price and have the option to continue with your order.

Additionally, Windy City has the sole discretion to reject any order that it considers libelous, defamatory, obscene, profane, portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, disability or national origin, containing explicit sexual content or is otherwise inappropriate for Windy City production.

You agree to not use Windy City's Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party.

Ownership of Artwork

Unless otherwise arranged prior to production, all artwork and digitizing (and whatever else you’re protecting)  created by Windy City Silkscreening for your order remains the property of  Windy City Silkscreening and will be maintained at our facility for our exclusive usage in executing your orders. Because our policy is to render art/ digitizing/etc. services for production orders solely on a cost-recovery basis, any transfer to the client of rights to creative works and materials prepared or contracted by our personnel is subject to reasonable release fees, commensurate with the creative services rendered and at a value as determined solely by us.   

Indemnity

You agree to defend, indemnify and hold Windy City and its affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or relating to your use of Windy City's Site and the Service, your violation of this Agreement, or your violation of any rights of another.

Governing Law

This Agreement shall be governed by the laws of the State of Illinois and, where applicable, by federal law.
